Divinova Solutions is committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA, Act 4 of 2013).

1. Who we are

Divinova Solutions is the responsible party for the personal information processed through this website and our client portal. Questions, objections and access requests may be sent to our Information Officer at info@divinova.app or by WhatsApp using the details below.

2. Information we collect

Identity details: full name, identity or passport number, date of birth and nationality.
Contact details: email address, mobile number, physical and postal address.
Company details: proposed names, registration numbers, addresses, MOI and share structure.
Director, member, shareholder and employee details needed for statutory filings.
Documents you upload: certified IDs, proof of address, tax documents and supporting records.
Payment information: payment references, amounts, proof of payment and payment status.
Technical data: IP address, device and browser information, and pages visited.

We collect only what is necessary and adequate for the service you request.

3. Why we process it (lawful basis)

To perform our contract with you and submit filings you have instructed.
To comply with legal obligations under company, tax and labour legislation.
To protect our legitimate interests, including fraud prevention and record keeping.
With your consent, for service updates and marketing you can withdraw at any time.

4. Who we share it with

We share your information only as needed to deliver your service: with CIPC, SARS, the Department of Employment and Labour, the B-BBEE Commission and similar authorities; with our bank; with our secure hosting and database provider; and with professional advisers where required. We never sell your personal information. Where any operator processes data outside South Africa, we require protection comparable to POPIA.

5. Direct marketing and WhatsApp

We contact you about your applications by email, dashboard notification and WhatsApp. Marketing messages are sent only where permitted, and every message includes a way to opt out. Reply "STOP" on WhatsApp or email us to unsubscribe.

6. Security safeguards

All data is transmitted over SSL/TLS and stored in encrypted, access-controlled databases. Access is limited to authorised Divinova personnel on a need-to-know basis, documents are stored in private buckets accessible only via expiring links, and access is logged. We review our safeguards regularly as required by section 19 of POPIA.

7. Retention

We keep your records for as long as needed to provide the service and thereafter for the periods required by South African law (generally five years for financial and statutory records). After that, records are deleted or de-identified.

8. Your rights under POPIA

To be told what personal information we hold about you.
To request access to that information.
To request correction, updating or deletion of inaccurate or excessive information.
To object to processing and to withdraw consent.
To not be subject to a decision based solely on automated processing.
To complain to the Information Regulator of South Africa.

9. Children's information

We do not knowingly process the personal information of children except where a parent or guardian provides it as part of a statutory filing and consents to it.

10. Security compromises

If a security compromise affects your personal information, we will notify you and the Information Regulator as soon as reasonably possible, as required by section 22 of POPIA.
